Welcome to Elanhaus. Throughout this document "we," "us," and "our" mean Elanhaus. We operate this website and the store it hosts, together with the content, tools, and features that come with it, to provide a curated shopping experience we refer to as the "Services." Elanhaus runs on the Shopify platform, which supplies the technical foundation behind those Services.

These Terms of Service ("Terms") set out what you can expect from us and what we expect from you. Read them carefully, as they cover important legal matters including warranty disclaimers and limits on our liability.

By browsing or otherwise using our Services you agree to these Terms and to our Privacy Policy. If you would rather not, please do not continue.

Section 1 — Account Access

By accepting these Terms you confirm you have reached the age of legal majority where you live. Accounts are personal and cannot be sold, transferred, or handed to someone else. Keeping your login secure is your responsibility, as is activity occurring under your account.

Section 2 — Our Products

We represent our products as truthfully as we can, though colors and finishes can appear differently depending on your screen. We cannot promise an item will look or perform exactly as displayed. Listings may change at any time, and we may limit availability or discontinue a product at our discretion.

Section 3 — Placing Orders

Submitting an order is an offer to buy, not a completed sale. Elanhaus may accept or decline any order. Nothing is final until we confirm it and process your payment. Please check your details before completing checkout. Returns and exchanges are handled under our separate Refund Policy.

Section 4 — Pricing and Payment

Prices may change at any time without advance notice. You pay the price shown at checkout and confirmed in your order confirmation email. Unless stated otherwise, listed prices exclude taxes and shipping. Providing accurate, current payment information is your responsibility.

Section 5 — Shipping and Delivery

Orders are typically prepared within one to three business days, with a further five to nine business days in transit. Shipping is free on every order, with no minimum spend. We ship to the fifty U.S. states and Puerto Rico only. Delivery windows are estimates rather than guarantees, and we are not responsible for delays caused by carriers, weather, or other matters outside our control. Once the carrier takes possession, responsibility for the parcel passes to you.

Section 6 — Intellectual Property

Everything on our Services — logos, product photography, written content, video, layout, and design — belongs to Elanhaus or to our licensors and is protected under intellectual property law. You may not copy, redistribute, alter, or repost any of it without our written permission. Rights not expressly granted here remain ours.

Section 7 — Third-Party Tools

We may occasionally give you access to tools built by other companies. These are provided "as is," without guarantee or endorsement from Elanhaus, and we are not responsible for how you use them.

Section 8 — Links to Other Sites

Our Services may link to websites we do not operate. We have no control over their content or practices and accept no responsibility for them. Following such a link is at your own risk.

Section 9 — Our Relationship with Shopify

Elanhaus runs on Shopify's platform, but every purchase is a transaction between you and Elanhaus directly. Shopify has no involvement in or responsibility for that transaction, and by using our Services you agree not to hold Shopify or its affiliates liable for anything arising from it.

Section 10 — Privacy

Personal data collected through the Services is governed by our Privacy Policy. Using the Services means you have read and understood how that information is handled.

Section 11 — Feedback

If you send us suggestions, reviews, or other feedback, you grant Elanhaus permission to use, adapt, publish, and share it as we see fit, without obligation to compensate you. You confirm the feedback is yours to give.

Section 12 — Errors and Corrections

Occasionally our site may carry a typo, an incorrect price, or missing information. Where that happens we may correct the error and, if necessary, cancel or adjust any affected order.

Section 13 — Acceptable Use

Our Services are for lawful use. You agree not to use them to break any law, infringe intellectual property, harass or harm others, distribute malicious software, collect other users' personal data without permission, or disrupt the site. We may suspend or terminate access for anyone who does.

Section 14 — Ending Access

We may withdraw your access to the Services at any time without advance notice. Any outstanding balance remains due. Provisions covering ownership, liability, and indemnification survive the end of your access.

Section 15 — No Warranties

OUR SERVICES AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT GUARANTEES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SOME JURISDICTIONS DO NOT PERMIT SUCH DISCLAIMERS, SO THIS MAY NOT APPLY FULLY TO YOU.

Section 16 — Limits on Liability

TO THE EXTENT PERMITTED BY LAW, ELANHAUS AND ITS OWNERS, STAFF, PARTNERS, AND LICENSORS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF OUR SERVICES OR PRODUCTS, INCLUDING LOST PROFITS OR LOST DATA, UNDER ANY LEGAL THEORY, EVEN IF WE WERE ADVISED SUCH DAMAGES WERE POSSIBLE.

Section 17 — Indemnification

You agree to indemnify and hold harmless Elanhaus, Shopify, and their affiliates, staff, and partners against claims or costs arising from your breach of these Terms, your violation of law, or your misuse of the Services.

Section 18 — Severability

If any part of these Terms is found unenforceable or invalid, that part is severed and the remainder stays in full effect.

Section 19 — Entire Agreement

These Terms, together with our Privacy Policy and any other referenced policies, constitute the complete agreement between you and Elanhaus regarding your use of the Services, superseding any earlier agreements on the subject.

Section 20 — Governing Law

These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles, and disputes arising from your use of the Services will be handled in the courts of Missouri.

Section 21 — Updates

We may revise these Terms as needed. Updates appear on this page and we will notify you where the law requires. Continuing to use the Services after a change takes effect means you accept it.
